Tort and insurance
We assist in tort and insurance related cases on an ongoing basis.
Our lawyers advise in tort cases involving both contractual and non-contractual obligations, mainly within the business sector (including professional and directors’ liability and maritime and transportation).
Compensation cases and claims arise both within and outside contracts, and often between professional parties in the business sector. If damage occurs, there is a need to clarify whether anyone can be held liable. This requires an investigation of the facts and the law, often involving lawyers, clients, and skilled external experts in close dialogue and cooperation.
We assist our clients in cases concerning liability and recourse after damage incidents, including in the areas of construction, board liability, transport, and all forms of professional liability. We demand that our clients' financial losses be compensated by the parties responsible for the damage, or through insurance coverage. Both our own and others' insurance coverage is investigated and followed up. Our assistance and experience apply to damage to property, objects, and pure financial loss. This also applies to damage that is wholly or partly caused by nature (natural damage), or where there is uncertainty about the scope of coverage or exceptions in an insurance policy.
We assist insurance companies and insurance customers in defending against liability claims, and help with legal follow-up of recourse claims and insurance law issues. Many cases are brought before district courts and courts of appeal throughout Norway every year.
We also litigate cases before the Supreme Court on behalf of corporate clients, insurance companies, and various interest groups.
Our contacts are Emanuel Feinberg and Ståle Hovda, both attorneys with the right to appear before the Supreme Court. Both Feinberg and Hovda have considerable experience in dispute resolution and litigation, as well as extensive experience from major cases in compensation and insurance law. They have also conducted such landmark cases before the Supreme Court.
